Pedestrian Struck at Crosswalk, Bangkok Inner City
Challenge
A British resident was struck by a private vehicle while crossing at a designated crossing near Silom. She sustained a fractured wrist and soft tissue injuries requiring six weeks of treatment. The at-fault driver initially denied responsibility, and the insurer was slow to engage.
What We Did
We gathered the police report, hospital records, and CCTV footage coordination. A demand letter was sent to the insurer with the full medical expense record attached. When the insurer's initial offer was insufficient, we submitted a counter-proposal with a detailed injuries schedule.
Outcome
Settlement reached at ฿178,000, covering medical expenses, loss of earnings for the treatment period, and general damages. Timeline: five months from engagement to payment. The matter did not reach court.
They told me at the start that this might take six months and cost more than I hoped. It took five and came in under my expectations. That is almost as good as it gets with these things.
Post-Surgical Complication Review, Private Hospital
Challenge
A Thai family believed a complication following an elective procedure at a private Bangkok hospital had been caused by surgical error. They had been told by another source that they might have a strong claim. They approached us for a second view.
What We Did
We reviewed all available medical records, the surgical notes, and the hospital's internal complication report. Our analysis considered the Thai standard of care applicable to the specialty and the causal link between the procedure and the complication.
Outcome
Our written opinion concluded that the complication, while serious, fell within the range of recognised surgical risks and that the clinical documentation did not support a finding of departure from the standard of care. We recommended a formal complaint to the hospital's patient relations team as a more appropriate step.
The news was not what we wanted. But they explained it clearly, and we believe them. We would have spent much more money finding out the same thing elsewhere.
Motorcycle Rental Accident, Phuket — Letter Prepared Remotely
Challenge
An Australian visitor was injured in a rental motorcycle accident in Phuket during a family holiday. She had to return home to receive follow-up treatment. Her travel insurer required a formal Thai demand letter before processing the claim.
What We Did
Working entirely by email, we received the police report, hospital discharge summary, and medical expense receipts. We drafted the demand letter in English and Thai, including a cover note explaining the documentation structure to the travel insurer.
Outcome
The travel insurer accepted the letter and processed the claim. Total turnaround from receiving documents to delivering final letter: nine working days. Fee: ฿3,950.
I was not even in the country and it was handled entirely by email within two weeks. That was more than I expected for the price.
