For the purposes of these Terms & Conditions, the following words carry the meanings set out below:

• Agreement — these Terms & Conditions, together with any engagement letter or fee agreement entered into between you and bodhicoud.
• Service — any of the legal services described on the bodhicoud website, including Road Traffic Accident Claim Representation, Medical Negligence Inquiry & Initial Review, and Injury Insurance Claim Letter Preparation.
• We / Us / Our / the Practice — bodhicoud, a legal services practice located at 65 Sathorn Soi 8, Silom, Bang Rak, Bangkok 10500, Thailand.
• You / User — any person who accesses or uses this website, or who engages the Practice for any Service.
• Content — all text, images, documents, and other materials published on this website.

2. Acceptance of Terms

By visiting this website or contacting us to enquire about or engage a Service, you indicate that you have read and understood these Terms & Conditions and agree to be bound by them.

If you do not agree with any part of these terms, you should not use this website or engage our services.

Our services are intended for individuals aged 18 or over who have the legal capacity to enter into a binding agreement. If you are acting on behalf of another person — for example, an injured family member — please indicate this clearly when you contact us.

3. Service Description & Availability

bodhicoud offers three personal injury legal services, each described on our Solutions page. These are:

• Road Traffic Accident Claim Representation — coordinated legal support for individuals injured in road incidents in Thailand.
• Medical Negligence Inquiry & Initial Review — a measured initial assessment of a possible medical negligence matter under Thai law.
• Injury Insurance Claim Letter Preparation — preparation of a demand letter and supporting documents for insurer-level settlement.

The Services are available to residents and visitors in Thailand. We do not offer advice on matters outside Thai jurisdiction unless agreed otherwise in writing. Service availability may be affected by capacity, complexity, or other factors at our discretion.

4. User Responsibilities

When using this website or engaging our Services, you agree to:

• Provide accurate, complete, and current information when submitting an enquiry or engaging a Service.
• Inform us promptly of any material change to the facts or circumstances relevant to your matter.
• Retain and provide all documents and records reasonably requested by us in connection with your matter.
• Communicate with us in a manner that is respectful and considerate.
• Not use this website for any unlawful purpose or in a manner that could damage, impair, or disrupt the website or its availability.

We rely on the accuracy of the information you share. Incomplete or misleading information may affect the quality of our advice and does not give rise to any liability on our part.

5. Intellectual Property

All Content on this website — including text, design, structure, and images — is the property of bodhicoud or its licensors. Nothing on this website transfers any intellectual property rights to you.

You are granted a limited, non-exclusive, non-transferable licence to access and view the Content for your personal, non-commercial use. You may not reproduce, distribute, modify, or republish any Content without our prior written consent.

Documents and letters we prepare on your behalf as part of a Service remain our intellectual property until the applicable fee has been received in full.

6. Fees & Payment

The fees for each Service are stated on our website in Thai Baht (฿) and are inclusive of VAT where applicable. Current fees at the time of publication are:

• Road Traffic Accident Claim Representation — ฿29,500
• Medical Negligence Inquiry & Initial Review — ฿11,800
• Injury Insurance Claim Letter Preparation — ฿3,950

Fees are payable as set out in the engagement letter for your matter. Where disbursements (court filing fees, translation costs, medical record retrieval charges) are anticipated, these will be discussed with you in advance and are not included in the quoted fee unless stated otherwise.

If your matter does not proceed after an Initial Review, the fee for that review is non-refundable. We will communicate clearly when a matter does not, in our view, have a likely path forward — and we consider that clear communication to be part of the service itself.

7. Scope of Engagement & Service Delivery

The scope of each engagement will be agreed in writing before work commences. We will not undertake work outside the agreed scope without first discussing an amendment with you.

Legal proceedings in Thailand, including civil court matters arising from road traffic accidents or medical negligence, are subject to procedural timetables set by the courts. We do not control court scheduling, the conduct of opposing parties, or institutional response times. Timelines described on our website represent typical patterns rather than commitments.

We maintain confidentiality in respect of all information shared with us in the course of an engagement, in accordance with our professional obligations and the terms of our Privacy Policy.

8. Disclaimers

This website is provided for general informational purposes. Nothing on this website constitutes legal advice, and reading it does not create a solicitor-client relationship between you and bodhicoud.

Legal outcomes depend on facts, evidence, and circumstances that we cannot assess until we have reviewed the details of a matter. Nothing on this website suggests or implies a particular outcome in any legal matter.

The website is provided on an "as is" basis. We make no representation that the website will be available at all times or that its Content is entirely free from error. We aim to keep information current but cannot commit to real-time accuracy.

9. Limitation of Liability

To the extent permitted by Thai law, our total liability to you in connection with any Service — whether in contract, negligence, or otherwise — shall not exceed the fee paid by you for that Service.

We shall not be liable for any indirect, consequential, or incidental loss, including loss of anticipated settlement proceeds, legal costs incurred with another adviser, or damage arising from delay caused by factors outside our control.

Nothing in these terms limits liability for death or personal injury resulting from negligence, or for fraudulent misrepresentation.

10. Indemnification

You agree to indemnify and hold bodhicoud harmless from any claim, loss, liability, or expense (including reasonable legal costs) arising from your breach of these Terms & Conditions, your misuse of the website, or any inaccurate or misleading information provided by you in connection with a Service.

11. Termination

Either party may bring an engagement to a close by giving written notice, subject to any terms set out in the engagement letter for that matter.

We reserve the right to decline or withdraw from a matter where we become aware of a conflict of interest, where continuing would require us to act contrary to our professional obligations, or where communication has broken down to the point that the engagement cannot continue constructively.

Fees for work completed prior to termination remain due and payable. Sections 5, 8, 9, 10, and 12 of these Terms survive termination.

12. Dispute Resolution

These Terms & Conditions are governed by the laws of Thailand. Any dispute arising under or in connection with these terms shall be subject to the jurisdiction of the Thai courts.

13. General Provisions

Entire agreement. These terms, together with any engagement letter and fee agreement, constitute the entire agreement between us in respect of the subject matter hereof.

Severability. If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

Waiver. Our failure to enforce any provision of these terms on any occasion does not constitute a waiver of that provision.

Assignment. You may not assign your rights or obligations under these terms without our prior written consent. We may, at our discretion, engage associate counsel or qualified staff in connection with the delivery of a Service.

14. Changes to These Terms

We may update these Terms & Conditions from time to time. The current version is always available on this page with the date of last revision at the top. If you have an active engagement with us when changes are made, we will notify you by email.
